Mediation is a method of resolving conflict in conjunction with the informed support of a neutral party.
Mediation is a method of reconciliation in conflicts of interest, that is to say, the mediator helps in finding a solution but has no decision-making power. This differentiates him fundamentally from a Judge or Arbitration Judge. The emphasis of his work is the creation of a good climate for discussion and negotiation and in bringing out oft hidden interest positions.
The aim of mediation is for the parties concerned to reach agreement whereby they voluntarily and on their own authority strive to achieve a fair and legally binding solution. At the same time, economic, personal and social aspects and interests can be given substantially better consideration than in court. At the forefront lies not the clarification of past facts but rather a good solution for the future.
Agreements made through mediation tend as a rule and to a greater extent to be preserved much longer when jointly made than, for example, in comparison with court decisions.
Mediation is a wide field in which lawyers and other occupational groups such as Psychotherapists, Psychologists and Management Consultants are jointly active. In many cases a mediator pair is retained consisting of a legally qualified person and a member of another occupational group. Each mediator is obligated and sworn to complete secrecy.
